Terms of Use for Speech Scriber

1. Introduction

Welcome to Speech Scriber ("App"). These Terms of Use ("Terms") govern your use of our mobile application operated by an individual developer ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the App.

2. Interpretation and Definitions

Definitions:

• App refers to Speech Scriber, the software program provided by us.
• Device means any device that can access the App such as a smartphone or tablet.
• Service refers to the App and transcription functionality.
• You means the individual accessing or using the Service.
• Media Files refers to audio and video files you provide for transcription.
• Transcription refers to the text conversion of your audio/video content.
• External Services refers to Gmail, Google Drive, Dropbox, and YouTube.

3. Use of the App

3.1. Speech Scriber is designed to transcribe audio and video files from various sources including Gmail, Google Drive, Dropbox, and YouTube links.

3.2. The App provides:

• Transcription services for uploaded media files
• Integration with External Services for file access
• Local storage of completed transcriptions on your device
• Minute-based usage system with free and subscription tiers

3.3. Processing limitations:

• Files may take up to 6 hours to process depending on length and complexity
• Media files are temporarily stored on our servers for processing and deleted after 3 days
• Internet connection is required for all transcription services

4. User Responsibilities and Content

4.1. You are solely responsible for:

• Ensuring you have legal rights to transcribe the content you submit
• Compliance with all applicable laws and regulations regarding the content
• Any copyright, privacy, or other legal issues related to your content
• The use and distribution of transcribed content

4.2. You acknowledge that:

• Content from External Services remains under their respective terms and policies
• We do not control or take responsibility for content stored on External Services
• You can transcribe any content, but you bear full responsibility for its use
• YouTube transcriptions are intended for personal use only

5. Subscription and Payment Terms

5.1. Free Usage:

• New users receive 60 minutes of free transcription time
• Free minute allocation may change without notice

5.2. Subscriptions:

• Available in weekly, monthly, and yearly plans
• Each plan provides specific monthly transcription minutes
• Unused minutes do not carry over and are forfeited at period end
• Minutes reset at the beginning of each billing period
• Minute allocations may be modified without prior notice

5.3. Payment and Refunds:

• All subscriptions are managed through Apple App Store or Google Play Store
• Refunds are governed by the respective app store policies
• We do not provide direct refunds
• Cancellation of subscription does not result in refund of unused minutes

6. Data Privacy and Security

6.1. Your transcriptions are stored locally on your device only.

6.2. Media files are temporarily processed on our servers and automatically deleted after 3 days.

6.3. Access tokens for External Services are stored only on your device.

6.4. We collect anonymous analytics data that cannot be linked to individual users.

6.5. Deleting the app permanently removes all locally stored transcriptions.

7. External Service Integration

7.1. The App integrates with Gmail, Google Drive, Dropbox, and YouTube.

7.2. You must comply with the terms of service of these External Services.

7.3. We request read-only access to your media files from these services.

7.4. You can revoke access to any External Service through the app's logout functionality.

7.5. We are not responsible for changes to External Service APIs or policies that may affect app functionality.

8. Intellectual Property

8.1. The App and its original content, features, and functionality are owned by the developer and protected by intellectual property laws.

8.2. You retain all rights to your original content and transcriptions.

8.3. You are responsible for ensuring you have rights to transcribe third-party content.

9. Disclaimer of Warranties

9.1. The App is provided on an "AS IS" and "AS AVAILABLE" basis.

9.2. We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Transcriptions will be 100% accurate
• The App will meet your specific requirements
• Processing times will always be within expected timeframes
• External Service integrations will always function properly

10. Limitation of Liability

10.1. In no event shall the developer be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to or use of or inability to access or use the App.

10.2. This includes but is not limited to damages for loss of data, loss of business, or any other commercial damages or losses.

10.3. You acknowledge that transcription accuracy may vary and you use results at your own risk.

11. Prohibited Uses

You agree not to use the App:

• To violate any applicable laws or regulations
• To infringe on others' intellectual property rights
• To circumvent usage limits or subscription requirements
• To reverse engineer, modify, or create derivative works of the App
• For any unlawful surveillance or privacy violations

12. Termination

12.1. We may terminate or suspend your access to the App immediately, without prior notice, for any breach of these Terms.

12.2. You may terminate your account by uninstalling the App.

12.3. Upon termination, your right to use the App ceases immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after changes constitutes acceptance of the new Terms.

14. Technical Requirements

14.1. The App requires a stable internet connection for all transcription services.

14.2. File processing may take significant time depending on file size and server load.

14.3. The App may not function properly on outdated operating systems or devices.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
